This Acceptable Use Policy ("AUP" or "Policy") governs all use of PulseCRM, PulseAPI, and related services, platforms, and systems (collectively, "Services") provided by 813 Management, LLC, a Utah limited liability company ("813 Management," "we," "our," or "us").
This Policy applies to all access to and use of the Services, including any APIs, SDKs, documentation, code repositories, developer portals, sandbox or production environments, and any systems or networks associated with the Services.
This Policy is incorporated by reference into, and supplements, any applicable agreements governing your use of PulseCRM and PulseAPI, including the Developer Terms of Service and any other terms published by 813 Management. In the event of a conflict between this Policy and any applicable agreement, the applicable agreement will control.
By accessing or using any Services, you agree to comply with this Policy. Violation of this Policy may result in immediate suspension or termination of access without notice.
1General Obligations
You shall:
- Use Services only for lawful purposes and in compliance with all applicable laws, regulations, and industry standards
- Maintain the security and confidentiality of all credentials and access tokens
- Promptly notify 813 Management of any unauthorized access or security incidents
- Comply with all applicable documentation, guidelines, and technical requirements
- Respect rate limits, quotas, and other usage restrictions
- Comply with all applicable card network, bank, processor, and industry compliance requirements (including PCI DSS where applicable), and any requirements communicated by 813 Management in connection with the Services
2Prohibited Uses: Illegal Activities
Strictly Prohibited
You shall not use Services for, in connection with, or to facilitate:
- Fraud: Any fraudulent, deceptive, or misleading activities, including identity fraud, account fraud, or transaction fraud
- Money Laundering: Money laundering, terrorist financing, or any activities that violate anti-money laundering (AML) laws or regulations
- Sanctions Evasion: Activities that violate U.S. sanctions, export controls, or trade restrictions
- Illegal Goods/Services: Processing payments for or facilitating the sale of illegal drugs, weapons, counterfeit goods, or other prohibited items
- Exploitation: Child exploitation, human trafficking, or any activities that harm minors
- Gambling: Unlicensed gambling, gaming, or lottery operations
- Other Illegal Activities: Any other activities that violate applicable federal, state, local, or international laws
3Prohibited Uses: System Abuse
You shall not:
- Attempt to gain unauthorized access to any systems, networks, or data
- Interfere with, disrupt, or impair the operation of Services
- Circumvent, disable, or interfere with security features, authentication mechanisms, or access controls
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive or discover source code, algorithms, models, data structures, schemas, or business logic from the Services or any related systems
- Introduce malware, viruses, worms, or other malicious code
- Conduct denial-of-service attacks or load testing without authorization
- Scrape, crawl, or harvest data except through authorized API calls
- Exceed rate limits or quotas through any means
- Share, transfer, or resell access credentials
- Create multiple accounts to circumvent restrictions or abuse free tiers
4Prohibited Uses: Competitive Activities
You shall not use Services to:
- Develop, improve, or operate any product or service that competes with PulseCRM, PulseAPI, or any 813 Management offering
- Conduct competitive intelligence gathering or analysis
- Benchmark or evaluate Services for comparison with competing products
- Reverse engineer features, algorithms, or functionality
- Test Services on behalf of a competitor
5Prohibited Uses: Content
You shall not use Services to store, transmit, or process:
- Content that infringes intellectual property rights
- Defamatory, libelous, or harassing content
- Content promoting violence, hatred, or discrimination
- Obscene or pornographic content
- Spam, phishing, or deceptive content
- Content that violates privacy rights
- Content that unlawfully collects, discloses, sells, or transfers personal information or sensitive data
- Any attempt to re-identify, de-anonymize, or correlate data to identify an individual or entity where such identification is not expressly authorized
- Content or data used to train, fine-tune, or improve machine learning or artificial intelligence models using data obtained from the Services, except where expressly authorized in writing by 813 Management
- Credential stuffing, account enumeration, phishing kits, malware, or other content intended to compromise accounts, systems, or networks
6Monitoring and Enforcement
6.1 Monitoring Rights
813 Management reserves the right to monitor, log, and analyze all use of Services to:
- Ensure compliance with this Policy and applicable laws
- Detect and prevent fraud, abuse, or security threats
- Protect the rights and safety of 813 Management and its users
- Respond to law enforcement requests
813 Management has no obligation to monitor the Services for violations of this Policy. Any failure to enforce this Policy in a particular instance does not constitute a waiver of 813 Management's right to enforce this Policy at any time.
6.2 Enforcement Actions
Violations of this Policy may result in, at 813 Management's sole discretion:
- Immediate suspension or termination of access without notice
- Removal of content or data
- Forfeiture of prepaid fees
- Reporting to law enforcement or regulatory authorities
- Civil litigation seeking damages and injunctive relief
- Recovery of attorneys' fees and costs
7Immediate Suspension Rights
813 Management may immediately suspend access, without prior notice or liability, if it reasonably believes:
- A violation of this Policy has occurred or is occurring
- Access poses a security risk to any systems or users
- Fraud or illegal activity is suspected
- Required by law enforcement or regulatory authorities
- Necessary to protect 813 Management, its users, or third parties
813 Management is under no obligation to provide an explanation, warning, or opportunity to cure before suspension.
8Reporting Violations

9Policy Modifications
813 Management reserves the right to modify this Policy at any time without prior notice. Continued use of Services after modifications constitutes acceptance of the modified Policy. It is your responsibility to review this Policy periodically.
10Governing Law
This Policy shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict-of-laws principles. You consent to exclusive jurisdiction and venue in the state and federal courts located in Salt Lake County, Utah.
By accessing or using any Services, you acknowledge that you have read, understood, and agree to comply with this Acceptable Use Policy.
